WAIVER OF LIABILITY AND ASSUMPTION OF RISK
Event at Private Residence
This Waiver of Liability and Assumption of Risk (“Agreement”) is entered into by the undersigned participant (“Participant”) in connection with attendance at an event hosted at a private residence located at:

Acceptance of this Agreement is a condition of entry to the event. Individuals who do not agree will not be permitted to attend.
1. Acknowledgment of Risk
Participant understands and acknowledges that attending a private event may involve inherent risks, including but not limited to:
- Slips, trips, and falls
- Injury from equipment, structures, or other attendees
- Food or beverage-related illness or reactions
- Noise, lighting, or environmental hazards
- Activities associated with entertainment (e.g., live music, dancing, use of equipment)
Participant voluntarily assumes all risks, known or unknown, associated with attending the event.
2. Protected / Released Parties
For purposes of this Agreement, “Released Parties” shall include, but are not limited to:
- Zahradka Family Farm, LLC
- MidAtlantic Mushroom Co
- George Zahradka 3rd
- Toni Zahradka
- Bernie Dieter Jr
- Chris Elwood
- All property owners, tenants, and residents of the event location
- All onsite and offsite vendors, contractors, performers, staff, volunteers, and affiliates associated with the event
3. Release of Liability (Including Negligence)
In consideration of being permitted to attend the event, Participant hereby releases, waives, and discharges the Released Parties from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while attending or participating in the event, INCLUDING ANY CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent permitted by law.
4. Express Negligence Waiver
Participant expressly acknowledges and agrees that this Agreement is intended to release the Released Parties from liability for their own negligence. Participant understands that this means they are giving up the right to bring a claim for injuries or damages caused in whole or in part by the negligence of any of the Released Parties, to the fullest extent permitted under Maryland law.
5. Indemnification
Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorney fees) that may arise due to Participant’s actions, negligence, or failure to comply with event rules.
6. Conduct and Responsibility
Participant agrees to:
- Act responsibly and follow all instructions provided by the host
- Not engage in illegal, reckless, or dangerous behavior
- Comply with all local laws and regulations
- Be responsible for any damage caused to the property or others
7. Alcohol and Substances (if applicable)
If alcohol is present, Participant affirms that they are of legal drinking age and agrees to consume responsibly. Participant assumes all risks associated with alcohol consumption and will not operate a vehicle while impaired. The host reserves the right to refuse service to any individual at their discretion.
8. Parking and Shuttle Transportation
Participant acknowledges that parking may be limited. If shuttle services or informal transportation are provided or utilized, Participant assumes all risks associated with such transportation, including entering/exiting vehicles and travel. Any transportation provided is voluntary and incidental to the event and is not a commercial transportation service. The Released Parties are not responsible for any injury, loss, or damage occurring during parking, walking, or transportation.
9. Live Music, Stage, and Electrical Equipment
Participant understands that the event may include live music, amplified sound, staging, lighting, and electrical equipment. These elements present inherent risks including loud noise, tripping hazards, and potential electrical hazards. Participant agrees to maintain a safe distance from all equipment and staging areas and assumes all risks associated with proximity to or interaction with such equipment.
10. Lighting Conditions / After Dark Entry
Participant acknowledges that portions of the property may have limited lighting, especially after dark. By entering or remaining on the premises after dark, Participant accepts all risks associated with reduced visibility, including uneven terrain and obstacles, and agrees to proceed with caution.
11. Medical Treatment
Participant consents to receive medical treatment deemed necessary in the event of injury, accident, or illness and agrees to be responsible for any associated costs.
12. Photography and Media (Optional)
Participant grants permission for photos/videos taken during the event to be used by the host for promotional or personal purposes.
13. Ticket Purchaser Representation
If Participant is purchasing tickets on behalf of other individuals, Participant represents and warrants that they have the authority to accept this Agreement on behalf of all attendees in their party and agrees that all such individuals are bound by its terms.
14. Condition of Premises
The event is provided on an “as-is” basis with no warranties or representations regarding the condition or safety of the premises.
15. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
16. Governing Law
This Agreement shall be governed by the laws of the State of Maryland.
17. Agreement and Electronic Acceptance
By checking the box during registration and purchasing a ticket, Participant acknowledges that they have read and fully understand this Agreement and voluntarily agree to be legally bound by its terms.
Participant further agrees that this electronic acceptance is intended to be the legal equivalent of a handwritten signature and is binding under applicable law.
